Merkury Smart is a trademark of Merkury Innovations LLC ("Merkury," "Merkury Smart," "we," "us," or "our"). This Privacy Policy describes how we collect, use, and disclose information when you:
- visit or make a purchase on our website, www.merkurysmart.com (the "Site");
- use the Merkury Smart mobile app or other software we provide (the "Software");
- use Merkury Smart connected devices ("Devices") and the Merkury Smart Cloud platform (the "Cloud Services").
The Site, Software, Devices, and Cloud Services are collectively the "Services." This Privacy Policy does not apply to how third parties collect, use, or disclose information — see the "Third-Party Services" section below.
By using the Services, you consent to the collection, use, and disclosure of information as described in this Privacy Policy.
1. Information We Collect

B. Information collected through the app, Devices, and Cloud Services
- Personal information: name, address, phone number, email address — collected when you register an account, communicate with us, or transmit data via a Device.
- Non-personal / device information: unique device ID (UDID), MAC address, IP address, Wi-Fi network information, OS/browser type and version, push notification identifiers, mobile network information, traffic and location data, usage/performance/diagnostic data.
- Location data: real-time location may be collected where required for core functionality (e.g., pairing a device to your home network, geo-based automations, organizing devices by address). We request permission for each such use and you may change permission settings at any time.
- Media and file metadata: if you grant permission, certain features may access photos, video, audio clips, or contacts stored on your device.
- Cookies and similar technologies: used on the Site for functionality and analytics. See Section 6 (Cookies).
2. How We Use Your Information
We use personal information to:
- Create and manage your account
- Fulfill orders, process payments, and arrange shipping
- Provide customer and technical support, including diagnostics based on Device data
- Send service-related communications (order confirmations, security notices, policy changes) — these are administrative and cannot be opted out of
- Send marketing communications where you have not opted out
- Operate the Send Help emergency-response feature (see Section 4)
- Conduct internal business purposes: data analysis, audits, product development, fraud/risk screening, identifying usage trends
- Comply with law, respond to legal process or government requests, enforce our terms, and protect our rights, safety, and property, and that of our users
Non-personal information may be used or shared for any business purpose. If combined with personal information, it is treated as personal information for as long as it remains combined.
3. How We Share Your Information
We do not sell personal information for marketing purposes. We disclose personal information to:

Service providers and affiliates who perform functions on our behalf, including:
- Shopify — storefront hosting, order processing (Shopify's privacy policy)
- Stratosphere IoT LLC — our affiliate, which provides platform, app, and Cloud Services infrastructure
- Recurly, Stripe, Apple In-App Purchase — subscription billing and payment processing
- Noonlight — emergency dispatch (see Section 4)
- Website hosting, data analytics, IT services, customer service, and email delivery vendors
- Business partners/customers who provide your Device or the networks through which you access the Services
- Successors in the event of a merger, acquisition, reorganization, or sale of assets
- Government authorities or law enforcement where required by law or legal process
- Third parties with your consent
4. Send Help Emergency Dispatch Feature
If you activate the Send Help feature, activating an emergency request transmits the following to our emergency-dispatch partner, Noonlight, and by extension to local 911 dispatch:
- Your verified or temporarily-entered address
- The type of emergency requested (police, fire, medical)
- Your phone number
- Device/camera identifying information
- Relevant event context (e.g., motion or person detection that triggered the request)
This data is transmitted only when you actively initiate or confirm a Send Help request. Noonlight's own privacy and data-handling practices govern its use of this information once received; we do not control those practices. See Noonlight's documentation for details.
5. Subscription and Billing Information
If you subscribe to a Merkury Smart video storage plan, we (or our billing processors) collect and process:
- Billing name, address, and payment method via Recurly and/or Stripe
- Subscription and purchase history via Apple In-App Purchase, where applicable

6. Cookies and Tracking Technologies
We use cookies and similar technologies on the Site for:

You can control cookies through your browser settings. Blocking cookies may affect Site functionality.
Do Not Track: There is no consistent industry standard for how to respond to "Do Not Track" browser signals. We do not alter our data collection and usage practices when we detect such a signal.
7. Your Rights
California (CCPA)
California residents have the right to:
- Know what personal information we collect and how it's used
- Access, correct, or delete their personal information
- Designate an authorized agent to submit requests on their behalf
- Opt out of the sale of personal information (we do not sell personal information for marketing purposes)

General access, correction, and deletion
You may request to access, update, correct, or delete personal information you've provided directly to us by contacting support@merkurysmart.com. We will authenticate your identity before processing requests. We cannot remove information already shared with third parties at your prior direction, and we may retain certain data to meet legal obligations.
8. Children's Privacy
The Services are not directed to individuals under 13, and we do not knowingly collect personal information from children under 13. If we learn we've collected such information without parental consent, we will delete it promptly.
9. Data Retention
We retain personal information for as long as necessary to fulfill the purposes described in this policy or to meet legal obligations, unless a longer period is required or permitted by law. Order information is retained until you request deletion (see Section 7).
10. Data Storage, Security, and International Transfer
- We store and back up personal information in databases located within and outside the United States. Data from accounts registered in the United States is stored in the United States.
- We use commercially reasonable physical, administrative, and technical safeguards to protect your information. No method of transmission or storage is 100% secure, and we cannot guarantee absolute security.
- By providing personal information, you consent to its transfer to other countries, which may have different data protection standards than your country of residence, except where prohibited by law.

11. Third-Party Services
The Services may link to or integrate with third-party websites or services we do not control (e.g., Shopify, Noonlight, Recurly, Stripe, Apple, Google, Amazon Alexa, Google Home). Their privacy practices are governed by their own policies, which we recommend reviewing directly. Links to third-party services do not imply endorsement.
12. Changes to This Policy
We may update this Privacy Policy periodically to reflect changes in our practices or for legal, regulatory, or operational reasons. Material changes will be posted here with an updated "Last updated" date.
